Please read these Terms of Service ("Terms") carefully before using the Velly mobile application and related services (collectively, the "Service") operated by Velly ("we", "us", or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Velly is a mobile live-streaming application for Android that allows users to broadcast video and audio to third-party streaming platforms (e.g. Twitch, Kick, YouTube). Optional paid features include network bonding via relay servers, cloud transcoding, and remote OBS control.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian.

3. User Accounts & Subscriptions

Certain features require a paid subscription purchased through the Google Play Store. Billing, renewal, and cancellation of subscriptions are governed by Google Play's terms. We do not process payments directly. You are responsible for keeping your device credentials and stream keys confidential.

4. Acceptable Use

You agree not to use the Service to:

broadcast content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable;
infringe the intellectual property or privacy rights of any third party;
transmit malware or interfere with the integrity of our servers or network infrastructure;
circumvent any access control or security mechanisms of the Service;
resell, sublicense, or commercially redistribute the Service without written permission.

We reserve the right to suspend or terminate access to the Service at any time if these Terms are violated.

5. Stream Content & Disclaimer of Responsibility

All content streamed through Velly is created and controlled solely by the user. We do not monitor, moderate, endorse, or assume any responsibility for user-generated stream content. Each user is solely liable for the legality, accuracy, and appropriateness of their streams.

When using the optional relay or transcoding servers, stream data passes through our infrastructure in real time and is not recorded or stored. We act purely as a technical intermediary and are not responsible for the content being transmitted.

If you become aware of any content transmitted through the Service that violates applicable law, please contact us at legal@velly.stream.

6. Third-Party Platforms

The Service integrates with third-party streaming platforms (Twitch, Kick, YouTube, etc.). Your use of those platforms is subject to their respective terms of service and community guidelines. We are not responsible for any actions taken by third-party platforms regarding your account or content.

7. Intellectual Property

The Velly application, its source code, design, trademarks, and related materials are the property of Velly and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the application for its intended purpose.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law:

We do not guarantee uninterrupted, error-free, or secure operation of the Service.
We are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.
Our total liability for any claim shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Velly and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your stream content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (e.g. limitation of liability, indemnification) will remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Italy, excluding its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Italy.
